Terms of use

These Terms of Use govern the relationship between the “Sports in Leisure” Association (the “Association”) and the users of the website located at the platform: https://sofiamarathon.bg/ (the “website”/”site”/”online platform”/”platform”). These Terms of Use apply to all visitors who access the website and/or use the features and content provided through it, regardless of the user’s location. The Association is not responsible if a user is located in a country whose legislation does not permit them to visit and/or use the platform.

The website https://sofiamarathon.bg/ is administered by the “Sports in Leisure” Association, the entity that holds the rights to organize the Sofia Marathon (the “marathon”) and to manage the website. By accessing the website, the user agrees to be bound by these terms.

To avoid any doubt, these Terms of Use constitute a binding agreement/contract between the “Sports in Leisure” Association and the users of https://sofiamarathon.bg/. By loading information on the homepage/navigating to an internal page/clicking on an active link on the site, the user accepts and agrees to comply with these Terms of Use. The Terms of Use are always available at https://sofiamarathon.bg/, and the “Sports in Leisure” Association reserves the right to modify and supplement them at any time without prior notice. For user convenience, when the Terms of Use are changed, the Association will publish a notice with the date of the most recent change on the page https://sofiamarathon.bg/.

Access to Services

Access to https://sofiamarathon.bg/ allows users to obtain information about the marathon without providing personal identification details. If a user wishes to register for participation on the platform, they must create a profile and provide accurate and up-to-date personal or corporate entity data. The processing of such personal data is carried out in accordance with applicable regulations and the rules published on the website.

The Association strives to maintain, update, and secure the databases of the online platform with the due diligence expected of information service providers. However, the Association informs users that occasional errors in the platform’s content or software may occur. Nonetheless, it guarantees that such errors will not hinder normal access to the online platform. If a user reports an error in the platform’s modules or functions, the Association commits to resolving the identified issue within a reasonable timeframe.

The user is required to follow the Association’s instructions, provided in written or electronic form, regarding the proper use of the online platform.

The Association is not responsible for actions taken by the user or any authorized representative that result in unauthorized or unlawful access to data stored in their online platform profiles.

The “Sport in Free Time” Association informs users that it may use data collection technologies to improve and enhance the online platform. Additionally, it may send notifications and information related to the platform’s functionalities and content via email or other communication methods.

The Association reserves the right to modify platform modules, functionalities, and these terms of use without prior notice to the user, provided that such modifications do not contradict applicable legislation or specific provisions of these terms.

The user is responsible for securing, at their own expense, the necessary computer equipment and internet connection required to access the platform’s modules and features in accordance with these terms. The Association is not liable for the quality of the internet service used by the user to access the online platform.

The Association shall not be held liable for any failure to fulfill its obligations under these terms due to force majeure, unforeseen circumstances, global internet issues, or other factors beyond its control. This includes instances where the user is unable to access the platform due to hardware issues, internet connectivity problems, or other similar reasons.

The user is responsible for any damages caused by malicious software used by them or as a result of any unlawful actions on their part.

Creating an Individual Profile (Natural Person)

To register as a participant in the Sofia Marathon, the user must create an account at https://sofiamarathon.bg/my-account/. The user is responsible for protecting their account and for any activity conducted within or through their account on the platform. The user guarantees that they are not located in a country where local legislation prohibits them from registering.

By accepting these terms of use, the user (natural person) declares that they fully understand and explicitly agree that the Association has the right to send electronic communications (including emails) to provide information about the Sofia Marathon, conduct inquiries on various topics, carry out surveys, and more. The user agrees to receive such messages.

Deleting an Account

Any user may request the deletion of their account. Upon deactivation, all stored information will be associated with an unknown creator. If the user wishes for all their profile information to be completely erased, they must submit a request to the following email: [email protected].

Creating a Corporate Profile (Legal Entity)

To register a group of participants from a legal entity for the marathon, a corporate account must be created at https://sofiamarathon.bg/my-account/. When creating a corporate profile, the representative of the legal entity must complete the registration form, providing the following details for each participant:

  • First Name
  • Last Name
  • Gender
  • Contact Phone Number
  • Country
  • Date of Birth (Age)
  • Email Address
  • Distance

The number of participants can be added as needed. It is the user’s responsibility to keep this information accurate and up to date. If necessary, the “Sport in Free Time” Association reserves the right to request additional clarifications. The legal entity is responsible for ensuring that the necessary conditions for collecting the personal data of the respective participants are met. The Association reserves the right to request proof of compliance with these requirements.

For issuing an invoice for the paid fee, the legal entity’s representative must also complete the following fields:

  • Company Name
  • Company Identification Code (EIK)
  • Company Headquarters/Address
  • Legal Representative (MOL)
  • Contact Email

The user is responsible for protecting their account and for any activity conducted within or through their account on the platform. The user guarantees that they are not located in a country where local legislation prohibits them from registering or registering the respective legal entities.

Intellectual Property and Trademarks

The “Sport in Free Time” Association has the legal authority to use all intellectual property related to the full functionality of the product and protects its rights to the maximum extent, as regulated by the applicable legal framework of the Republic of Bulgaria and the European Union.

The trademarks and logos published by the Association on https://sofiamarathon.bg/ are either owned by or licensed to the “Sport in Free Time” Association or the entity specified on the website. None of the product’s functionalities grant, directly or indirectly, any license or rights to the trademarks without the explicit written permission of the “Sport in Free Time” Association or the respective trademark/logo owner.

The “Sport in Free Time” Association holds the rights (including industrial and intellectual property rights) to publish and use the content found on this website.

Any reproduction, transmission, modification, or use of the content on this site for purposes other than personal, non-commercial use requires prior written consent from the “Sport in Free Time” Association or an authorized representative. The Association and the respective rights holders reserve all rights to the content of this website.

Participation Rules

If adverse weather conditions are expected, the “Sport in Free Time” Association reserves the right to require participants to carry additional mandatory equipment.

During the race, participants must follow the marked course designated for the competition without deviating from its boundaries. Any deviation from the course may result in disqualification unless it is due to getting lost and does not provide an unfair advantage to the competitor.

The “Sport in Free Time” Association may set a maximum completion time for each participant. The maximum time limits for different distances are published on the race website. If a participant exceeds the designated maximum time, their participation may be terminated.

Each participant must review the information provided by the “Sport in Free Time” Association via email. Participants should familiarize themselves with the specific characteristics of the course they plan to race on and assess whether their personal abilities align with the chosen course.

All participants are required to protect the environment in the race area. Littering along the course may result in disqualification at the discretion of the “Sport in Free Time” Association.

Aid stations will be set up along the racecourse, where participants can access food and beverages provided for the event.

Each participant is responsible for their own safety during the race. The “Sport in Free Time” Association will provide a medical team to ensure the safety of all participants. However, the Association is not liable for any damages incurred by participants during the race, including repatriation costs and medical expenses.

Participants agree that they may be photographed or recorded on video during the event, and these materials may be used by the “Sport in Free Time” Association for marketing purposes, including the promotion of future editions of the race and other activities of the Association.

Withdrawal from participation is possible up to 45 days before the event by sending a request to [email protected]. In such cases, the “Sport in Free Time” Association will refund the registration fee via bank transfer, deducting administrative fees for the transaction.

Changes to registration regarding race distance or participant details can be made up to 30 days before the event by contacting [email protected].

Eligibility to participate in the Sofia Marathon is granted to individuals who are 14 years of age or older, have registered for the event, and have paid the registration fee, or have been granted a free entry by the “Sport in Free Time” Association. Participants under 18 years of age must submit a signed parental or guardian consent form to take part in the race.

Content and Liability

The “Sport in Free Time” Association is responsible for keeping the website content up to date. Content created by users is entirely their responsibility, and they bear full liability for any damages resulting from such content. Except for direct damages caused by intentional misconduct or gross negligence on the part of the “Sport in Free Time” Association, the Association shall not be liable for any direct, indirect, or consequential damages suffered by users of this website arising from or in connection with their visit to the site. This limitation applies, without restriction, to lost profits, business interruptions, and data loss.

The “Sport in Free Time” Association shall not be liable for any direct, indirect, or other damages resulting from the use or inability to use this website.

Disputes

All disputes, including those related to the application of these Terms of Use, that may arise between a user and the “Sport in Free Time” Association will be resolved through mutual agreement. If a resolution is not possible, the dispute will be settled by the competent court in the Republic of Bulgaria in accordance with the applicable Bulgarian legislation.

The “Sport in Free Time” Association complies with all regulatory acts in force in the Republic of Bulgaria and the European Union. Under these Terms of Use, the Association expressly informs its users of their right to benefit from the dispute resolution mechanisms outlined in Regulation (EU) No. 524/2013 on online consumer dispute resolution, amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC.

In accordance with these regulations, users have the right to choose out-of-court dispute resolution through the European Online Dispute Resolution (ODR) platform, which applies to disputes arising from contracts for the sale or provision of online services between consumers residing in the European Union and traders based in the European Union. Personal Data Protection

As a data controller, the “Sport in Free Time” Association (hereinafter referred to as “the Association”) complies with all requirements of (EU) 679/2016 General Data Protection Regulation (GDPR), the Personal Data Protection Act (PDPA), and all other applicable legal regulations. The Association collects, processes, and stores only data necessary for the registration of participants in the Sofia Marathon on https://sofiamarathon.bg/ (“the website”).

Principles for Collecting, Processing, and Storing Personal Data

When processing personal data, the “Sport in Free Time” Association follows the principles of lawfulness, fairness, and transparency; purpose limitation; data minimization; accuracy and timeliness; storage limitation; integrity and confidentiality; and ensuring an appropriate level of security for personal data.

The Association may process and store personal data to fulfill its obligations under applicable Bulgarian legislation. By registering on https://sofiamarathon.bg/, each user explicitly agrees that the Association may process their personal data. The data provided will be used exclusively for participant registration, statistical purposes, or direct communication with the user. The data will not be edited, shared with third parties, or used for purposes other than those described, unless required by law or with the user’s explicit prior consent.

Types of Personal Data Collected, Processed, and Stored

The Association collects only the personal information (“Data”) voluntarily provided by users during registration for the Sofia Marathon via the registration form:

  • First and Last Name – for identifying participants in the ranking by distance.
  • Date of Birth – for assigning participants to age groups.
  • Country – for statistical analysis of marathon participants.
  • Phone Number – for contacting participants in case of registration issues.
  • Email Address – for communication with participants.
  • Gender – for ranking participants in male and female categories.
  • Distance – for creating the starting lists by race distance.

The legal basis for processing this personally identifiable information is the contractual relationship that arises between the Association and the user upon acceptance of the Terms of Use and/or registration on the website.

Additionally, the Association processes and stores data related to the user’s IP address for security improvements, interface localization, and statistical and marketing research. The processing of this data is based on the legitimate interests of the administrator and the necessity of contract execution between the data subject and the Association.

Restrictions on Data Processing

The “Sport in Free Time” Association does not collect or process personal data related to:

  • Racial or ethnic origin
  •  Political, religious, or philosophical beliefs
  • Trade union membership
  • Genetic and biometric data
  • Health status
  • Sexual life or orientation

The Association does not perform automated decision-making using personal data.

General Provisions

If any clause of these Terms of Use is declared null or invalid, regardless of the reason, this shall not affect the validity of the remaining clauses. These Terms of Use are created, applied, and interpreted in accordance with Bulgarian law.

Within the scope of these Terms of Use, the “Sport in Free Time” Association shall not be held liable for any errors that may appear on the website, regardless of the cause, including changes that were not made by the website administrator.

The “Sport in Free Time” Association accepts payments through the following methods:

  • Bank transfer
  • ePay.bg micro-account
  • Credit or debit card payments (Payments are not accepted from cards issued in the following countries: USA, Canada, Brazil, Mexico, Australia, New Zealand, UAE, Belize, Bahrain, Colombia, Trinidad and Tobago, Kuwait, India, and Nigeria)
  • Cash payments at EasyPay locations

Final Provisions

If the event cannot be held on the announced date due to circumstances beyond the control of the “Sport in Free Time” Association, the participant is not entitled to a refund of their registration fee, unless explicitly agreed upon with the “Sport in Free Time” Association.

The “Sport in Free Time” Association reserves the right, under the circumstances specified in this section, to reschedule the event and notify the participants accordingly. Participants will be granted the right to participate in the Sofia Marathon on the newly announced date. However, the Association is not responsible if a participant is unable to attend on the rescheduled date.

The content of the official website https://sofiamarathon.bg/ is copyright protected, with the rights held by the “Sofia – European Capital of Sport” Foundation. Anyone wishing to use the website content must obtain prior authorization from the rights holder.
